The NHRC’s Opinions on the Ministry of Justice’s April 16th, 2025, Amendments on Partial Articles of the “Regulations for Executing the Death Penalty”

Article 2, Subparagraph 5 of the Organic Act of the Control Yuan National Human Rights Commission (NHRC) authorizes the Commission to systematically study domestic constitutional and legal frameworks, with reference to international human rights standards, and to propose necessary and feasible recommendations for constitutional amendments, legislation, and legal reforms. In fulfilling its constitutional mandate to protect the rights of the people, establish the foundational conditions for promoting and safeguarding human rights, ensure the realization of social fairness and justice, and align with international human rights standards in upholding universal values and norms, the Commission hereby submits its opinions on the Ministry of Justice’s April 16th, 2025, partial amendments to the Regulations for Executing the Death Penalty. The Commission's opinion is based on the key principles articulated in Constitutional Court Judgment No. 113-Hsien-Pan-8 (2024) and the requirements and standards of international human rights laws. The Commission further urges the Ministry of Justice to reexamine the Regulations, solicit views and opinions from experts, scholars, and civil society organizations, and ensure that the amendments fully comply with constitutional frameworks and international human rights standards.
