The NHRC’s Recommendations regarding the draft Artificial Intelligence Fundamental Act Announced by the National Science and Technology Council on July 15, 2024


The National Human Rights Commission (hereafter “the NHRC”) was established to fulfill the constitutional mandate of safeguarding the rights of the people, laying a foundation for the promotion and protection of human rights, ensuring social fairness and justice, and aligning with international human rights standards to uphold the universal values and norms of human rights. Pursuant to Article 2, Paragraph 5 of the Organic Act of the Control Yuan National Human Rights Commission, the NHRC is tasked with conducting systematic research on the Constitution and domestic laws following international human rights standards, and with proposing necessary and feasible constitutional amendments, legislative enactments, and legal revisions.


In response to the draft Artificial Intelligence (AI) Fundamental Act announced by the National Science and Technology Council (NSTC) on July 15th, 2024, the NHRC has formulated its recommendations with reference to international human rights standards, including the UN Guiding Principles on Business and Human Rights (UNGPs), and the Council of Europe’s Framework Convention on Artificial Intelligence, and Human Rights, Democracy and the Rule of Law. These recommendations were revised and formally adopted at the NHRC’s 57th meeting of the First Term, held on September 30, 2024.
