National Human Rights Commission (NHRC) Opinions and Recommendations regarding the Executive Yuan’s Anti-Discrimination Law Draft Bill Announced on May 2, 2024


1. The NHRC was established to protect the rights of the people as stipulated in the Constitution of the Republic of China (Taiwan), to lay the foundation for the promotion and safeguarding of human rights, to ensure the realization of social fairness and justice, and to ensure that Taiwan remains in alignment with international human rights standards and universal human rights values. Pursuant to Article 2, Paragraph 5 of the Organic Act of the Control Yuan National Human Rights Commission, the NHRC is authorized to systematically study the Constitution and relevant laws in compliance with international human rights standards and to propose necessary and feasible recommendations for constitutional amendments, new legislation, or amendments to the law.


2. In response to the Anti-Discrimination Law draft bill announced by the Department of Human Rights and Transitional Justice under the Executive Yuan on May 2, 2024, the NHRC offered opinions and recommendations during the draft bill’s public notice period. These opinions and recommendations were based on the content of international human right conventions, general comments, and previous concluding observations of reviews of the reports of the Government of Taiwan. These comments and recommendations were approved during the 54th meeting of the NHRC’s 1st session, held on June 25, 2024.
